Terms of Service

These Terms of Service ("Terms") govern your access to and use of HouseCleanerPRO, operated by JGM Real Estate Solutions LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and authorized to operate a cleaning business in your jurisdiction. By using the Service you represent that all information you provide is accurate.

2. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at hello@housecleanerpro.biz of any unauthorized use.

3. Subscription & Billing

HouseCleanerPRO offers paid subscription plans. By selecting a plan and providing payment information, you authorize us to charge you on a recurring basis at the rates displayed at the time of purchase. Plans auto-renew unless cancelled before the renewal date.

Refunds: We offer a pro-rated refund for unused time if you cancel within 7 days of an annual charge. Monthly plans are non-refundable once the billing period begins.

Payments are processed by Stripe. We do not store your payment card information.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Transmit spam, unsolicited messages, or harmful content to your clients through the Service
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Reverse-engineer or extract the source code of the Service
• Resell or white-label the Service without written permission

5. Your Data

You own the data you enter into HouseCleanerPRO — client records, job history, invoices, and financial data. We process it only to provide the Service and as described in our Privacy Policy. You may export or delete your data at any time by contacting us.

6. AI Features

The AI Receptionist, EOD reports, and AI reply suggestions use third-party AI models (Anthropic Claude). You are responsible for reviewing AI-generated content before acting on it and for complying with applicable call-recording laws when using the AI phone agent.

7. SMS & Email Communication

By using SMS and email features, you represent that you have obtained any required consents from your clients to receive automated messages. You are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and similar regulations.

7a. Messaging Program Terms (for message recipients)

HouseCleanerPRO sends SMS text messages on behalf of the cleaning businesses that use our Service to their clients who have opted in. Messages include appointment confirmations and reminders, invoices and payment links, tip requests, review requests, and follow-ups to quote requests.

Message frequency varies based on your interactions with the business. Message and data rates may apply. Text HELP for help. Text STOP to unsubscribe at any time; after replying STOP you will receive no further messages. For support, contact admin@housecleanerpro.biz. See our Privacy Policy for how we handle your information. Carriers are not liable for delayed or undelivered messages.

8. Intellectual Property

The HouseCleanerPRO name, logo, software, and all associated intellectual property are owned by JGM Real Estate Solutions LLC. These Terms do not grant you any right to use our trademarks or brand assets.

9. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. Use of the Service is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, JGM Real Estate Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the Service. Our total liability to you in any calendar year shall not exceed the amounts you paid us in that year.

11. Termination

You may cancel your account at any time from the Billing page. We may suspend or terminate your account if you violate these Terms, with or without notice. Upon termination, your right to access the Service ends. We may retain your data for up to 90 days after termination before deletion.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the app. Continued use after the effective date constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Westmoreland County, Pennsylvania.
